NOTICE OF PUBLIC HEARING FOR PROPOSED ORDINANCE # 766
NOTICE IS HEREBY GIVEN that the Board of Commissioners of the Township of Darby, Delaware County, Pennsylvania, intends to consider for adoption at a public meeting to be held on Wednesday, November 4th, 2026, at 7:00pm, at 21 N. Bartram Avenue, Glenolden, PA. 19036 a Ordinance #766. imposing an Earned Income and Net Profits Tax. The following is a summary of the proposed Ordinance:
The Ordinance imposes, for general revenue purposes and pursuant to the Pennsylvania Local Tax Enabling Act, a tax at the rate of one percent (1.0%), effective January 1, 2027, upon: (1) earned income earned by residents of the Township of Darby; (2) earned income earned by nonresidents for work performed or services rendered within the Township; (3) net profits from unincorporated business activities conducted by residents of the Township; and (4) net profits from unincorporated business activities conducted by nonresidents within the Township.
The Ordinance provides for the filing of tax returns and payment of the tax by taxpayers; requires employers to register, withhold and remit the tax and file required returns; provides for administration and collection by the designated Tax Officer in accordance with the Local Tax Enabling Act and applicable policies and procedures of the Tax Collection Committee; and provides for applicable interest, penalties, costs and fines for noncompliance.
The Ordinance further provides for the repeal of inconsistent ordinances or parts thereof and contains a severability provision.
The Ordinance and the tax imposed thereby shall become effective January 1, 2027, and shall remain in effect thereafter on a calendar-year basis without annual reenactment unless repealed or modified by subsequent ordinance of the Board of Commissioners.
